session Thursday, August 26, 2004,
in the Geauga West Library, 13455 Chillicothe Road,
at 6:33 p.m.

2004-376. Mrs.
Mula moved to approve and sign Purchase Order #PO 40141
to Ford Credit, Detroit, Mich.,
for $7,644.13 for the semi-annual lease
payment of cruisers from Fund 9-A-10 and Voucher Warrant #VW 45637. Mr. Stevens
seconded.

Mula moved to approve and sign Purchase Order #PO 40142
to Best

Mula moved to approve up to $525.00 payable to
APA/OPC Planning
and Zoning Workshop, Attn:
Melissa Schneider, MKS Consulting, Solon, Ohio, for registration fees of
$75.00 each for the following people: Mike Joyce, Margaret Muehling, Ruth Aster,
Cathy Cotman, John Gorka, Garth Grant, and Richard Makowski. Mr. Stevens
seconded.
Vote: Unanimous. Motion passed.
Discussion ensued regarding the updating of information to
be placed on the UAN (United Accounting Network). Clerk Austin
requested over-time pay be approved by the Board for her Assistant to do this
necessary project of updating the information on the UAN.
Decision made the Clerk’s Assistant will not answer Town
Hall telephones on a three week trial basis in order for this above-listed
information to be put on the UAN. No overtime granted by the Board at this time
for the Clerk’s Assistant Marie Roche.

PUBLIC HEARING – Paving of Sherman Road – 7:00
p.m.
Mrs. Mula opened the
hearing of the paving of Sherman Road
at 7:03 p.m.
2004-387. Mrs.
Mula moved to waive the reading of the legal notice. Mr. Stevens
seconded.
Vote: Unanimous. Motion passed.
Mrs. Mula asked that all
people wishing to speak at this public hearing state their name and address in
order that the Clerk can record the names. Explanation of the procedures at a public
hearing and gave an overview of this project and the various people she has
spoken with regarding the various methods of paving of roads in other
communities which has been brought up in the past by some of the residents on
Sherman Road.
Also addressed by Mrs. Mula was her
conversation with the County Engineer R. L.
Phillips.
Mrs. Mula noted that bond
counsel, Mike Sharb from Squire, Sanders and Dempsey,
and Chuck Mascella, Chester Township Road Superintendent were present to answer
any questions the residents may have regarding this paving project.
Wendy Zahler, 9509
Sherman Road referenced Ohio Revised Code which
states that the Board of Trustees may make alterations from what is recommended
by the County Engineer. Further, the Board of Trustees should not
approve such a project if the cost is too costly. See letter from Ms.
Zahler attached to the minutes, which she read in
total.
Mike Sharb, Attorney, Squire,
Sanders & Dempsey, explained what has taken place to this date to get this
project to where we presently stand. The purpose of this hearing tonight was to
hear objections. The Board has already determined that this
project will go forward. It is the Board’s discretion to continue on
with the hearing if objections are not the main issue.

Sharb’s comments.
Mrs. Mula asked for Mr.
Montague and Mr. Stevens’ input as to how the
Board wishes to proceeds since Mr. Sharb said it was at the Board’ discretion.
Mr. Stevens said he has
read everything the residents have given to him, and he is here to hear what
the residents have to say. We have the room until 9:00 p.m.
Mr. Montague said this is
an assessment hearing. A determination was made that we would be
going ahead with this project. The dollar amount is now the question and the
individual personal assessment(s) is what this hearing is about. This project is going ahead.
Mrs. Mula asked that all
questions and comments be kept brief so that all of the concerns of the
audience can be heard and addressed before 9:00
p.m.,
which is the time we have this room for tonight.

What exactly is cement stabilization?
Mrs. Mula said this type of
cement stabilization is being recommended by the County
Engineer from this point forward
whenever road work has to be done. It is for the longevity of the road.
Mr. Mascella said cement
stabilization has a proven track record that it works.
Charles Sells, 9580 Sherman Road,
said the road was not built properly to begin with.
Wally Hoffman, 9480 Sherman Road,
said the road was an old farm trail. The residents on the road just inherited the
old road, which was then made into a road; i.e.,
Sherman Road.
The majority of Sherman Road
residents present objected to the cost of paying for the cement stabilization
of the road including those who are totally in favor of the paving project.
