The Chester Township Board of Trustees met in regular session Thursday, April 22, 2004, in the Town Hall Meeting Room at 7:01 p.m.  Vice-chairwoman Patricia M. Mula, presided.

 

Trustees Mula and Stevens present and Clerk Austin.

The Board led the audience in reciting the Pledge of Allegiance to the Flag.

 

BID OPENING – 7:00 P.M.- The Pavement Recycling and Asphalt Resurfacing of Various Roads in Chester Township

 

2004-172.  Mrs. Mula moved to waive the reading of the Legal Notice.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

2004-173.    Mrs. Mula moved to forward the bids on to the County Engineer and the

Chester Township Road Superintendent for their review and recommendation.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

2004-175.Mrs. Mula moved to approve up to $1,330.00 payable to Radick’s

Landscaping, 9925 E. Washington St., Chagrin Falls, Ohio 44023, for the hydro-seeding of ditches along Sperry Road from Fund 4-B-03.  Mr. Stevens seconded.

2004-176.Mrs. Mula moved to approve up to $800.00 payable to Podojil

Excavating Co., 13337 Lawnbury, Chester Township, for bulldozer work at the Mulberry storage yard from Fund 4-B-03.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

 

 

 

2004-177.Mrs. Mula moved to approve up to $10,200.00 payable to Universal Oil,

Inc., PO Box 93687, Cleve., Ohio 44101, for the purchase of marathon supreme

diesel fuel for the Road and Fire Depts. With the following distribution:  Fund 4-A-05 $9,010.00 and Fund 10-A-09 $1,190.00.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

 

2004-178.Mrs. Mula moved to approve and sign Purchase Order #PO 40077 for

$2,000.00 to D.J.L. Material & Supply, Inc., for Crafco 221R Crack Seal and/Freight

from Fund 4-B-02; Purchase Order #PO 40078 for $1,330.00 to Radick’s Landscaping, 9925 E. 2004-179.Mrs. Mula moved to approve authorization for the Township Clerk to

execute an appropriation transfer of funds within the General Fund in the amount of $2,000.00 from line item 01-B-06 “Purchases and Replacements” to line item account 01-B-03 “New buildings and additions, land purchases” for the purchase of one Encore Prowler Grounds Mower.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

 

2004-180.  Mrs. Mula moved to approve and sign Voucher Warrants #VW 42836 through 42869.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

 

Clerk’s Note:  The ending # on April 15, 2004, was 42835; the beginning # on April 22, 2004 is 42836.

 

2004-181.Mrs. Mula moved to adopt the following policy to  be added to Chapter 8

EMPLOYEE CONDUCT of the Chester Township Policy Manual as SECTION 8.16 WEAPONS POLICY:  TO ALL EMPLOYEES:  EFFETIVE IMMEDIATELY THE

CARRYING OR POSSESSION OF ANY WEAPON, INCLUDING GUNS, CONCEALED OR OTHERWISE AT ANY TIME DURING YOUR WORK SHIFT IS STRITLY PROHIBITED.  VIOLATORS WILL BE SUBJECT TO DISCIPLINARY ACTION, UP TO AND INCLUDING DISMISSAL AND POTENTIAL CRIMINAL

PROSECUTION.  THIS POLICY DOES NOT APPLY TO POLICE OFFICERS CARRYING APPROVED/QUALIFIED WEAPONS.  Mr. Stevens seconded.  Vote:  Unanimous.  Motion passed.

 

Trustees concur to contact the Chairman and Joe Diemert regarding an Executive Session for discussion of the police union contract.  Mr. Stevens will contact Mr. Montague and Mr. Diemert.

 

Clerk Austin said she will prepare a spreadsheet for a comparison of banks as to the fee structure for each bank.  The banks are:  Sky Bank, Huntington Bank and Key Bank.

 

Mr. Stevens said he will be attending the next meeting of the Chagrin River Watershed Partners on May 13, 2004. 

 

Clerk Austin reported on the amounts of the revenue received from the bonds for Mr. Spellman, one check for $10,000.00, another check for $10,000.00 and one for roughly $3,000.00 which is a partial payment.  Copies of the checks did go to the Assistant Geauga County Prosecutor Rebecca Schlag before the checks were deposited into the Chester Township account.

 

 

Mrs. Mula referenced the domain name which was previously registered as “chestertwp.org” (which was under Mr. Spellman’s name) to be forwarded on to our legal counsel for review and input.  The cost is minimal to secure this domain name, $85.00 for five years.  Mr. Stevens concurs with Mrs. Mula that “chestertwp.org” be secured as the domain name.

 

Clerk Austin reported $5,485.96 that was collected during the month of March for estate taxes from Geauga County and, also, a check for $8,134.99 for estate taxes through Cuyahoga County from someone who had assets in Geauga County. 

 

Discussion ensued as to the time frame the estate checks are received after someone passes on.

 

ZONING INSPECTOR

 

Zoning Inspector Mike Joyce reported on various matters which include the processing of mulch at the corner of Mayfield and Caves Road, the dumping of dirt at the Windridge property by the Ohio EPA from a sewer project on SOM Center in Mayfield Village, properties with agricultural uses, and a tower which was put in by the State for the security systems located on the Marx property on Mayfield Road which is also used for 911 communication purposes in Geauga County. 

 

Mr. Cotman referenced some of the projects that the CAC is currently investigating.

 

PUBLIC INPUT

 

Ms. Neubig, Mulberry Road, said numerous trucks are going in and out of two properties near her home; where is the protection for the homeowner?

 

Mr. Joyce said one property belongs to a landscaper with an agricultural use and the other property owner is operating under Court approval. 

 

Ms. Neubig expressed her concern about what is happening near or on her property. 

 

Mrs. Mula said this situation is between Ms. Neubig and her neighbor; she has been informed over the years that this is a civil matter. 

 

Ms. Neubig feels the township should be responsible to the residents.  Various incidents which happened on the Nuebig property explained by Ms. Neubig.  

 

Mrs. Mula said the Police Department follows the laws of the State of Ohio when answering a call from a resident.  Over the years, the township has tried to assist the Neubig’s by contacting various individuals and departments.  The Neubig’s option is that of a civil matter. 

 

Mr. Stevens added that he has talked with Ms. Neubig and is now going to contact Mr. Pot for his side of the story.
